Beachwood
Estates Home Owners Association Pool Rules and Regulations
The
following Rules and Regulations are for the protection and benefit of all to
assure safe and sanitary operation of the pool facilities. Your cooperation in abiding by these
conditions will afford a pleasant relation and recreation for all
concerned. Parents are requested to
caution their children to observe all rules and regulations and obey
instructions of all employees.
Any
failure to comply with these rules shall be considered sufficient cause for any
action deemed necessary by the management, including barring violators from the
use of the pool area. Beachwood Estates
HOA reserves the right to authorize admittance to the pool pending the HOA fees
being paid in full before the opening of the pool. Beachwood Estates HOA also reserves the right to decide a
homeowner's eligibility if they have any current violations of the Beachwood
HOA Bylaws.
The
pool will be in the charge of a qualified head lifeguard and his/her assistants
who will be under direct supervision of the management. All persons using the pool will be required
to register with the attendant.
1.
All
persons using the pool or pool area do so at their own risk and sole
responsibility. The management does not
assume responsibility for any accident or injury in connection with such
use. The homeowner agrees with the
management and/or HOA for and in consideration of the use of the pool as an
added facility and other good and valuable consideration to make no claim
against the management and/or HOA for or on account of any loss or damage of
life, limb or property sustained.
2.
The
users agree to save harmless, the management and/or HOA from any and all
liabilities and action of whatsoever nature by and guest or guests of the homeowner
growing out of the use of the swimming pool or pool area.
3.
Guests
will be permitted to use the pool only while accompanied by an eligible
homeowner. Guest passes may only be obtained by eligible homeowners. Guest
passes will only be good for the time stated on the guest pass. Homeowners will be held responsible for all
actions of their guests. Failure to
comply will result in action by the management.
4.
The
cost of any property damage will be charged to the responsible party.
5.
Management
will not be responsible for loss or damage to any personal property of any
kind.
6.
The
use of the pool area is permissive only.
There will be no fee for the use of the pool by homeowners.
7.
The
pool may be closed down at any time due to either breakdown or other operational
difficulties and at the discretion of the head lifeguard.
8.
All
bathers must shower before entering the pool.
9.
Children
under 12 years of age MUST be accompanied by a resident that is 16 years or
older for admission to the pool area. If the child is in the large pool, the
guardian must be in the immediate vicinity of the child unless the child has
demonstrated adequate swimming ability as determined by the lifeguard on
duty. The child's guardian is responsible
for the child's conduct.
10.
Infants
and children wearing diapers or who are not toilet trained shall be permitted
in the pool, but must wear tight fitting rubber pants or "swim
diapers". In the event of fecal
contamination, the pool will be closed in accordance with Health Department
regulations.
11.
Running,
pushing, wrestling, ball playing or causing undue disturbance in or about the
pool area will not be tolerated.
12.
No
diving or jumping towards the walls will be permitted.
13.
Floatation mats and rafts are not permitted
in the pool at any time. Life preservers, water wings or other instructional
devices may not be used in the pool unless the guardian is in immediate
vicinity of the child.
14.
No
smoking on pool property. Dispose of any smoking articles in the appropriate
receptacles upon entering the pool area.
15.
No
pets are allowed within the pool area.
16.
No
bicycles, motorbikes, skateboards or other wheeled vehicles are permitted in
the pool area.
17.
Baby
strollers or baby carriages are not permitted within ten (10) feet of the pool.
18.
Chewing
gum is not permitted in the pool area at any time.
19.
Only
proper type bathing suits are permissible.
20.
Admission
shall be refused to all persons having any infectious disease, sore or inflamed
eyes, colds, nasal or ear discharges, or any communicable disease, or any kind. Persons with excessive sunburn, open sores,
or bandages of any kind will not be permitted.
21.
Spouting
of water and similar unhygienic actions will not be permitted in the pool.
22.
No
abusive or profane language or breach of the peace will be tolerated.
23.
Consideration
of noise levels, parking, and littering should be taken into account for
surrounding residents.
24.
No
intoxicants may be brought into the pool area.
All beverages or food brought into the pool area must be in paper or
plastic containers. Glass containers
are not permitted. All trash must be
disposed of in a trash container.
25.
All
persons use this facility at their own risk, and in conformance with all rules
and regulations. Any person may be
barred from the pool at the discretion of the attendant in charge for violation
of rules and regulations, or for any other reason, which in the judgment of the
attendant constitutes a hazard to others or to the management.
26.
The
head lifeguard is responsible for the strict enforcement of the rules. He/she has authorization to temporarily
deprive any homeowner or guest of this facility. A written statement is to be filed with the management within 24
hours if such action is taken.
27.
Management
reserves the right to refuse entry or deny pool privileges to anyone at it's
sole discretion. Beachwood Estates HOA
also reserves the right to deny pool privileges pending HOA fees and
violations.

homeowner's signature on the pool pass application indicates that the Beachwood
Estates Home Owners Rules and Regulations have been read and that all residents
of your household understand and will abide those rules whenever using the pool
facilities.
